The U.S. Department of Health & Human Services has been tasked with distributing $175 billion to hospitals and other healthcare providers in response to the COVID-19 pandemic. A significant portion of these funds, which are grants, not loans, are being distributed to post-acute and long-term care providers. Providers have suffered lost revenues, disruptions to service delivery, and increased expenses, among other consequences – all within a matter of a few months and at a level unprecedented in recent history. While these funds were very much needed, it is important to recognize they come with strings attached in the form of terms and conditions intended to define appropriate use and protect against fraud.
For example, each payment requires recipients to attest to specific terms and conditions, provide estimates of revenues lost in March and April of 2020, upload tax return data, and comply with future reporting requirements, many of which have yet to be fully defined.
